1. Scope and seller
These Terms & Conditions apply to contracts concluded through liltheria.com and to individual art commissions agreed directly with:
Linda Wolters
trading as Liltheria
Am Landhaus 46
59555 Lippstadt
Germany
Email: shop@liltheria.com
Any conflicting customer terms apply only if expressly accepted by us. Products or services offered through an external platform are additionally subject to the contractual process and mandatory terms of that platform.
2. Products and services
The shop offers physical goods, including tote bags, and downloadable digital products, particularly brush files for creative software. The products currently available are shown in the shop. Individual art commissions are prepared on the basis of a separate quote following a non-binding enquiry.
For digital products, images and examples illustrate possible results. Results may vary depending on the software, device, settings and way in which the product is used. The description on the relevant product page forms part of the offer.
For physical products, please refer to the product page for the materials, dimensions, available variants and care information. Screen settings can affect the appearance of colours; this does not limit the agreed product characteristics or your statutory rights.
3. Formation of a shop contract
The presentation of products in the shop is not a legally binding offer but an invitation to place an order. You can place products in the cart, review the order and correct input errors before submitting it.
For paid products, you submit a binding offer by selecting the button that clearly indicates an obligation to pay. For products offered free of charge, you submit your order by selecting the corresponding order or download button.
The automatic acknowledgement of receipt confirms that the order has reached us and does not by itself constitute acceptance unless it expressly states otherwise.
We may accept your offer by sending an express order or dispatch confirmation, dispatching the physical goods, or making a digital product available for download. The earliest of these events determines when the contract is concluded. If a paid order is not accepted, payments already collected will be reimbursed.
4. Contract language and order information
The contract language is English. Before submitting an order, you can identify and correct input errors using the cart and checkout controls.
The order details and these Terms & Conditions are made available during checkout. You will receive the essential order information by email. We store order data in accordance with statutory retention duties. If you create a customer account, order information may also be available in your account.
5. Prices and payment
All prices are stated in euros. The small-business regulation under Section 19 of the German Value Added Tax Act (UStG) applies; VAT is therefore not shown separately.
Shipping charges apply to physical goods as stated on the Shipping & Payment Information page and are displayed separately before you place your order. Digital-only orders have no shipping charges. No payment is due for products expressly marked as free.
The payment methods currently available for paid orders are displayed during checkout. Availability may depend on the customer’s device, location and the selected payment provider. Payment is due when the order is placed unless expressly agreed otherwise.
6. Physical delivery and digital supply
Physical products are delivered only to addresses in Germany. Shipping charges and delivery times are set out on the Shipping & Payment Information page and, where applicable, the relevant product page. Physical goods remain our property until the purchase price has been paid in full.
Digital products are supplied electronically. No physical item is shipped for a digital product.
Free products are made available after checkout has been completed. Paid products are made available after successful payment confirmation. The download link is provided in the order information and sent to the email address entered during checkout.
You are responsible for providing a working email address and for using compatible software and hardware. Product-specific file formats and compatibility requirements are stated on the relevant product page.
7. Right of withdrawal
Consumers may have a statutory right of withdrawal. The conditions, time limits, consequences and model withdrawal form are provided on the Right of Withdrawal page.
A withdrawal may also be submitted through the electronic cancellation function.
For paid digital content supplied before the end of the withdrawal period, the right of withdrawal expires only after delivery has begun and the customer has expressly consented to immediate delivery, acknowledged the resulting loss of the right of withdrawal and received the legally required confirmation.
For digital content supplied without payment of a price, the right of withdrawal may expire when performance begins in accordance with the applicable statutory provisions.
For physical goods, the statutory withdrawal period generally begins when you or a third party designated by you, other than the carrier, takes possession of the goods. The detailed conditions and return procedure are set out on the Right of Withdrawal page. Early-supply consent for digital content applies only to the digital content in the order and does not remove the right of withdrawal for physical goods.
Statutory rights relating to defective goods and digital content remain unaffected.
8. Defects and statutory rights
Statutory rights relating to defective physical goods and digital products apply. Products will be supplied free from product and legal defects as required by law.
If you experience a problem with a delivered item, download or file, please contact shop@liltheria.com and include the order number and a description of the problem. Providing this information helps us investigate the issue but does not limit your statutory rights. For defective goods, statutory rights and any applicable rules on return expenses remain unaffected by the provisions on withdrawal.
9. Licence for downloadable brushes and digital tools
Unless the product page expressly states otherwise, acquiring a downloadable brush or digital tool grants you a non-exclusive, non-transferable right to use it to create your own personal and commercial finished artwork.
You may not:
- share, upload, sublicense, sell, rent or otherwise distribute the source files;
- include the source files in another brush pack, asset library, template or competing product;
- make the source files available to clients, team members or third parties who have not obtained their own licence; or
- claim authorship of the supplied brush or source asset itself.
Copyright and all rights not expressly granted remain with Liltheria. Acquiring a digital product does not transfer ownership of the intellectual-property rights in its source files.
10. Website content and copyright
Product images, illustrations, texts, designs and other content published on this website may not be reproduced, distributed or commercially exploited beyond permissions granted by law or an express licence.
Purchasing a physical item transfers ownership of that item only. Copyright, reproduction rights and other intellectual-property rights in the design or artwork are not transferred unless expressly agreed otherwise.
11. Individual commissions
Enquiry and booking
A commission enquiry is non-binding. A commission is booked only after the scope, price, intended use and schedule have been confirmed in text form, for example by email, and the quote has been accepted.
Payment
Unless the quote states otherwise, 50% of the agreed fee is due upfront to secure the booking. The remaining 50% is due when the first sketch is delivered. Final high-resolution files are supplied after all due payments have been received.
Revisions and customer cooperation
Two revision rounds during the sketch stage are included unless the quote states otherwise. Major changes after sketch approval, additional revision rounds or changes to the original brief may require an additional fee and an adjusted schedule.
The customer must provide clear instructions and references and confirms that they are entitled to provide and use all submitted material. Delayed feedback may postpone completion.
Content and age restrictions
We may reject enquiries that fall outside the subjects or boundaries stated on the Commission page. Customers requesting NSFW artwork must be at least 18 years old. Illegal, hateful, discriminatory or rights-infringing content will not be accepted.
Usage rights
The base commission price includes personal, non-commercial use only. Publication for business purposes, advertising, resale, merchandising, cover use and other commercial exploitation require a separate licence defining the permitted use, duration, territory and any exclusivity.
Copyright remains with the artist unless expressly agreed otherwise. Unless confidentiality has been agreed before booking, the artist may display the completed work and process excerpts in a portfolio and on social media. Personal contact details will not be published.
Schedule and withdrawal
Turnaround times are estimates unless a binding deadline has been expressly agreed. A preferred deadline submitted through the enquiry form is not automatically binding.
If work is to begin before the statutory withdrawal period has expired, any separate request, consent, acknowledgement or information required by law will be obtained before work begins. Statutory consumer rights remain unaffected.
12. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act, and where a guarantee has expressly been given.
For slight negligence, we are liable only for breach of an essential contractual obligation whose performance is necessary for the proper execution of the contract and on whose performance the customer may regularly rely. In that case, liability is limited to the foreseeable loss typical for the contract. Mandatory statutory liability remains unaffected.
13. Consumer dispute resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
14. Applicable law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law does not deprive them of mandatory protections that apply under the law of the country in which they habitually reside.
If an individual provision is invalid, the remaining provisions remain unaffected. Mandatory statutory provisions take precedence.
